The
bail fate of Arusha Urban Member of Parliament, Godbless Lema
(Chadema), failed to be known yesterday after the Government's lawyers
raised an objection, opposing the High Court, Arusha Region, to hear
bail applications submitted by the defendant's lawyers.
Acting
Judge of the Court, Judge Sekela Moshi, said that due to the objection,
he will listen to the legal arguments presented to the court before
giving any decision on the accused's bail.
He directed the lawyers of both sides to submit legal arguments before the court proceeded with any action.
Judge Moshi said he will issue a decision on the legal dispute on November 22, this year
In
the application number six of 2016, Jamhuri was represented by lawyers,
Matenus Marandu and Paul Kadushi while Lema is defended by a panel of
six lawyers namely Peter Kibatala, John Mallya, Adam Jabir, Sheck
Mfinanga, Faraji Mangula and Charles Adiel.
In
the hearing yesterday, the legal objections started to be heard at 4:54
in the morning until 7:25 in the afternoon where the lawyers of the
Government and those of the defense side, fought hard to make arguments.
Presenting
the objection, lawyer Kadushi, asked the court to allow them to submit
one objection and if the court fails to approve the objection, they
should submit a second objection.
He
claimed that the application signed by lawyer Kibatala is aimed at
article 372 (1) of the Criminal Procedure Law which gives the High Court
to review the proceedings of lower court cases.
